Stephen Baldwin accused Deutsche Bank of refusing to negotiate with him over the foreclosure of his Nyack, New York, home
Actor Stephen Baldwin is fighting to save his New York home from foreclosure after being accused of owing the bank more than $1million in years of unpaid mortgage payments.
Baldwin has headed to court to demand the case be thrown out and is accusing Deutsche Bank of refusing to negotiate
with him and not even owning the promissory note to his Nyack, New York, property.
The actor claims the bank 'lacks standing to bring the action, as Plaintiff does not have clear chain of title for the mortgage and promissory note', which is a legal document in which a person promises to repay his or her loan to the lender.
In 2013, Deutsche Bank filed a foreclosure lawsuit against Baldwin and his wife, Kennya, accusing them of defaulting on their loan by failing to make payments.
The bank headed back to court in June to demand the actor and his family be ordered to vacate their Nyack home and allow a foreclosure on the property.
But on August 17, Baldwin attempted to have the entire foreclosure suit thrown out in hopes of saving his the home from being sold off at public auction.
In 2000, Baldwin and his wife took out an $812,500 loan to purchase the four-bedroom, four-bathroom, 3,071 square-foot home.

The bank claims that the actor stopped paying his mortgage in 2011, and, at the time of the filing, still owed a total of $781,991.02 on the loan
he deal stated that the couple were to pay nearly $7,000 a month on the mortgage.

The lawsuit has been pending for years, with Baldwin never filing a response to the allegations in the complaint until now.
After years of no response from Baldwin, Deutsche Bank went back to court on June 29 demanding the case move forward after Baldwin ignored the lawsuit completely.
Deutsche Bank is pleading for the green light to begin the foreclosure process on the home and is demanding that the actor be ordered to pay the current debt owed on the mortgage, which totals in at $1,097,644.33, plus interest.
In his court filings, Baldwin says that if the bank cannot produce the proof of loan in a timely manner, the case should be dismissed.
He claims that under New York law, to bring a foreclosure lawsuit, a plaintiff must own both the mortgage and the note.
The actor says that Deutsche Bank does not own the note and suggests that the bank may not even own the mortgage on his home.

He argues that he didn't borrow any money from Deutsche Bank, and therefore, doesn't owe any money.
Further, he claims that he made payments to the bank but wasn't properly credited.
He believes that the bank wrongfully declared a default against him and accuses the company of not acting in good faith to negotiate a settlement, adding that the bank has rejected his short sale applications without good reason or a detailed denial.
Baldwin is demanding that the entire foreclosure lawsuit be thrown and the bank be awarded nothing.
The youngest of the four acting Baldwin brothers has had a string of financial troubles over the years, most notably being charged with failing to file his New York state tax returns for multiple years back in 2012.
He eventually pleaded guilty in the case and agreed to pay $300,000 in back taxes and serve five years of probation.
The 50-year-old, who starred in 'The Usual Suspects,' has been at the Republican National Convention this week in Cleveland, giving interviews in support of presidential nominee Donald Trump.
He has been a vocal Trump supporter since appearing on the GOP presidential candidate's reality show, The Apprentice.
